18 U.S.C. § 2257 Exemption Statement

AfricanPorn (“we”, “us”, “the Website”) is an adult video index that embeds and links to visual depictions of sexually explicit conduct that are hosted on third-party websites.

We do not produce, shoot, commission, direct, or otherwise create any of the visual content displayed on AfricanPorn. All videos are hosted by independent third-party producers, studios, and platforms, and are embedded or linked using publicly available embed codes and URLs.

2. Status under 18 U.S.C. § 2257

Because AfricanPorn functions solely as an index and search service that embeds content from third-party hosts, we are, to the best of our knowledge, classified as a secondary producer (or exempt entity) under 18 U.S.C. § 2257 and 28 C.F.R. Part 75.

All primary record-keeping obligations under 18 U.S.C. § 2257 for the visual depictions of actual sexually explicit conduct appearing on the embedded videos are the responsibility of the original producers, studios, and hosting platforms that create and host such content.

3. Location of records

To the extent that 18 U.S.C. § 2257 applies, the required age verification records for any visual depictions of actual sexually explicit conduct displayed via AfricanPorn are maintained by the respective primary producers of the content.

Viewers who wish to obtain information regarding the location of records for a particular video or series should contact the producer, studio, or platform identified in the content itself (for example, the watermark, title, or credit information displayed in the video).

It is our strict policy to allow only content in which all performers or models were at least eighteen (18) years of age at the time of production. We do not knowingly index, link to, or embed any material that involves minors or that could be interpreted as child sexual abuse material.
